These Terms & Conditions ("Terms") govern participation in the EMCO Technology Referral Program (the "Program"). By submitting a referral through the Program, you ("Referrer") agree to be bound by these Terms. EMCO Technology, Inc. ("EMCO," "we," "us," or "our") reserves the right to update these Terms at any time, as described in Section 9 below.

Referrals for companies already in EMCO's sales pipeline, existing clients, or former clients within the past 12 months do not qualify.

7. Tax Responsibility
Any reward issued under this Program may be considered taxable income to the recipient under applicable law. Referrers are solely responsible for determining and satisfying any tax obligations arising from their receipt of a reward. EMCO may request tax information (such as a completed Form W-9) for rewards meeting applicable reporting thresholds.
8. Use of Information
By submitting a referral, the Referrer confirms they have a good-faith basis to believe the referred company would welcome being contacted by EMCO. Information submitted through the referral form will be used by EMCO to evaluate the referral and to contact the referred company regarding EMCO's services, consistent with EMCO's Privacy Policy. EMCO will not use Referrer contact information for purposes unrelated to the Program without consent.
9. Program Changes and Termination
EMCO reserves the right, at its sole discretion, to modify, suspend, or terminate the Program, or to amend these Terms, at any time and without prior notice. Changes will apply to referrals submitted after the effective date of the change. Referrals submitted and confirmed as Qualified Leads prior to any such change will remain subject to the reward terms in effect at the time of submission.
10. General Terms
Participation in the Program does not create any employment, agency, partnership, or joint venture relationship between the Referrer and EMCO.
EMCO's decisions regarding referral qualification, reward eligibility, and reward amounts are final.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
